What it is

The Health, Safety and Welfare Schedule is Schedule 3 of our Terms of Business for the supply of agency workers (EQL-TOB-01). It is part of the contract every client signs before we supply workers, and it says who does each safety task while our workers are on the client's site. The full wording is in the Terms of Business.

What the client agrees to

  • Induction — a site induction on or before the first day (hazards, safe working, emergencies, first aid, how to report accidents and concerns). Induction time is working time.
  • PPE — free to the worker. The client supplies the PPE its risk assessment requires, unless the assignment details say we supply an item. Nobody may charge a worker for PPE or deduct its cost from pay.
  • Risk assessment — the client shares its risk assessment for the work with us and tells us of any change, including any specific assessment for a new or expectant mother or a young person.
  • Accidents and RIDDOR — the client, as the person in control of the premises, reports any RIDDOR-reportable event to the HSE and gives us the reference within 24 hours, and tells us of every accident, injury, near miss or dangerous occurrence within 24 hours.
  • Harassment — all reasonable steps to prevent harassment of our workers, including by its staff, contractors, customers and visitors; telling us straight away of any report. A worker may report to us instead of the client.
  • Facilities and vacancies — from day one, the same access to shared facilities as the client's own staff, and information about vacancies.
  • Working time — the breaks and rest the law requires; telling us before asking for more than 48 hours a week or night work; recording actual start and finish times.
  • Stopping unsafe work — a worker may leave a place of serious and imminent danger, and is never penalised or removed for doing so or for raising a safety concern.
  • Site visits — we may visit before first supply and at least every six months to review these arrangements.
  • Records — the client keeps a written record (paper or electronic) of each worker's site and job induction, the supervision arrangements, first aid and fire cover on every shift, and its check that each worker holds any licence or training the task needs — and gives us or a Fair Work Agency officer copies within 2 working days of a request. Changes to shifts, breaks or overtime are agreed only through us.

What we do

We check the site before we supply, check each worker is suitable, pass on the risk information in a form the worker understands, record any PPE we provide, record every incident, and re-check the site after any serious incident. See our health and safety policy.
